The DIP box said vacant. The broker called it empty. Then the auction special conditions named a protected occupant, or the seller’s solicitor still held a licence to occupy, or the buildings schedule showed someone sleeping there until completion. Credit does not stall on the LTV first. It stalls because the bridging loan file claimed vacant possession without papers that prove the house will be empty when funds land.

StatusKWO underwrites short commercial facilities for professional buyers, landlords and SPVs. Main-home owner-occupier work sits outside that book. Published pricing currently shows a monthly rate from 1.25%, an entry fee of 2%, an exit fee of 1.5%, LTV up to 85%, loans from £10,000 to £10,000,000+ and terms up to 16 months. Those card figures do not turn a soft vacant claim into an empty property.

The vacant DIP that stalls when someone is still in the house

A clean decision in principle on an empty title is worthless if occupation papers contradict the covering email. Brokers who reuse yesterday’s vacant template on a part-let or notice-served file force a second question list that should have been page one.

Our tenancy and deposit pack covers live lets. The auction legal pack note covers searches and special conditions. The page you are reading is narrower. It is the vacant possession and occupancy evidence a specialist desk wants before it funds an unregulated commercial bridge sold or priced as empty.

Start the enquiry with one page. Address and title number. Vacant, part vacant or occupied. Who holds keys today. Whether anyone sleeps, stores goods or trades from the property. Gross and net loan. Term. Named exit. Then attach the vacant possession warranty, key schedule or notice trail before the glossy brochure. Credit can skim a brochure. They cannot invent empty rooms from a tick box.

GOV.UK’s private renting pages still set the baseline for how occupation works in England. Specialist credit is not writing consumer mortgage advice. It still needs the occupancy claim on the application to match the papers in the zip.

What vacant possession means on sale auction and refinance files

Vacant possession is a completion promise, not a marketing adjective.

On a sale exit the seller usually warrants vacant possession on completion unless the contract says otherwise. Credit wants that warranty named in the contract extract or solicitor note. A portal listing that says “vacant” is not enough. Our sale-exit pack already asks for a diary and Plan B. Add the vacant possession clause next to the diary so nobody confuses a sale that still has a sitting occupant with a clean empty handover.

Auction lots need sharper eyes. Special conditions often preserve a licence, a short occupation or goods left behind. Read the condition that deals with vacant possession before you bid. If the catalogue says vacant and the special conditions carve that back, put the carve-back on page one of the pack. A twenty-eight day auction finance clock does not invent empty rooms when the conditions never promised them.

Refinance bridges against stock the borrower already owns need an honest occupancy line too. A refinance that clears a first charge on a house the borrower’s relative still occupies is not a vacant file. Say who is there. Say on what basis. Credit would rather price occupation than discover a mattress during the valuer’s inspection.

Portfolio finance books that mix vacant and let titles need a per-title occupancy map. Do not hide one occupied unit behind nine empty ones. Credit opens the odd title first.

Keys alarms meter reads and the empty-property declaration credit opens

Empty means more than “no tenancy PDF”.

Send a dated empty-property declaration from the seller or borrower. Name the title. State that nobody resides there. State whether furniture, tools or stock remain. State the date keys leave the seller’s control. Soft wording such as “should be vacant” fails. Credit wants a signed statement, not hope.

Key schedules matter. Who holds the front door key today. Who holds the alarm fob. Which solicitor will release keys on completion. A broker email that says “keys with agent” without a named agent stalls the file when the lender’s solicitor asks for the release letter.

Meter reads and utility letters help when the property has been empty for months. They are not mandatory on every light bridge. They become useful when insurance, valuation or local searches raise damp, leak or illegal occupation questions. Attach what you have rather than inventing a utility trail that does not exist.

Alarm and boarding notes sit beside the declaration on long-empty stock. If windows are boarded or the alarm is monitored, say so. Valuers notice. Insurers notice. Credit notices when the declaration says vacant and the photographs show curtains drawn at midday with washing on the line.

Identity still sits in the general bridging pack note. An empty-property declaration does not replace source of funds or company papers. It sits beside them.

Valuers will test the empty claim in person. If the inspection finds a bed, post with a living person’s name or heat in a supposedly cold house, expect a second round of questions the same afternoon. Send the declaration before the valuation instruction so the valuer is not the first person to notice the gap. A bridge that looked clean on email can lose a week when the inspection report comes back with “appears occupied”.

Notices Form 3A and why a soft vacant claim fails after May 2026

England’s private renting rules changed on 1 May 2026. Soft talk about “serving notice” no longer means a section 21 path for private landlords.

GOV.UK’s guide on repossessing a privately rented property after 1 May 2026 is blunt. Private landlords cannot use section 21. Possession normally starts with a section 8 notice using Form 3A or a form substantially to the like effect, stating the ground and giving the right notice period. If the tenant stays, the landlord applies to court for a possession order. You cannot remove someone by force.

Credit does not need a possession-law essay. It needs the trail.

If the file claims vacant because a tenancy has ended, show how it ended. Tenant notice. Surrender. Court order. Or a live Form 3A with the ground named and the expiry date. GOV.UK’s ending a tenancy page for assured periodic tenancies and the assured tenancy forms list are the primary sources for the paperwork shape. A covering line that says “tenant leaving soon” without a dated notice fails.

Do not treat a notice period that has not expired as vacant possession today. Price the bridge on occupation that still exists, or wait until the keys are back. Stretching the term because “possession is nearly there” usually weakens the residual rather than strengthening it.

Illegal eviction risk is not a specialist-lending product feature. GOV.UK is clear that removing tenants without the correct process can be a criminal offence. A professional borrower who plans works the day after completion still needs lawful vacant possession first. Credit will not fund a plan that assumes a locked-out occupant.

Leasehold flats add consent and subletting layers. Our leasehold and ground rent pack covers tenure. If the lease demands vacant possession on sale or restricts short occupation, put that clause next to the vacant claim.

Part-occupied lots licences and how auction special conditions change the ask

Not every “vacant” lot is empty.

Part-occupied houses, rooms with licencees and commercial units with a caretaker create three different underwriting stories. Name which rooms are empty. Name who remains. Name the document that allows them to stay. A licence to occupy is not an assured periodic tenancy, but it still blocks a clean vacant possession warranty until it ends.

Auction special conditions often deal with fixtures, rubbish and occupation. Read the condition that shifts risk to the buyer. If the buyer takes the lot subject to whatever occupation exists on completion day, say that before you ask for vacant pricing. Our auction memorandum and deposit note covers the post-hammer papers. Add the occupation carve-out from the special conditions into the same zip.

Goods left behind are a practical vacant possession issue. Sofas, tools and trade stock can delay works and insurance. Ask the seller’s solicitor whether clearance is included. If the buyer clears after completion, budget for it and say so. Credit prices delay when a “vacant” house still needs a skip before contractors start.

Development finance and heavy works bridges that start the day after completion need the same honesty. A works programme that assumes empty rooms on Monday fails if a licencee still holds a bedroom. Put occupation next to the first draw narrative.

Party wall or adjoining works can also collide with occupation. Our party wall evidence note covers adjoining notices. Vacant possession of the security is still a separate ask.

Commercial and semi-commercial lots need the same discipline. A shop with a flat above can be vacant at ground floor and occupied upstairs. Name each part. A caretaker flat that stays live while the trading unit empties is still occupation for insurance and for any vacant possession warranty that covers the whole title. Do not let the trading unit’s empty shelves stand in for the residential floor above.

Unoccupied insurance sale exits and what brokers should put in the first zip

Buildings cover changes when nobody lives there.

Our buildings insurance pack already flags occupancy. Empty files need the unoccupied wording in the open. Many schedules restrict cover after a set empty period or demand inspections, boarding or alarm conditions. Attach the schedule and the occupancy endorsement. An empty-property declaration that contradicts the insurance schedule is a credit event, not a clerical footnote.

Sale exits still need a diary and Plan B even when the stock is empty. Vacant possession helps the sale story. It does not replace buyer interest, price evidence or a refinance illustration. EPC and MEES still sit on tenanted exits and future lets. Our EPC and MEES pack covers the energy papers. Do not assume an empty house can be re-let tomorrow without band and exemption checks.

Brokers who send one clear zip save a day of chase. Name the files so a human can open them.

  1. One-page summary with title number, loan ask, exit and a plain vacant, part vacant or occupied line.
  2. Signed empty-property declaration or vacant possession warranty extract from the sale contract.
  3. Key and alarm schedule naming who holds access today and who releases on completion.
  4. Auction special conditions extract where occupation or vacant possession is carved back.
  5. Form 3A, surrender, tenant notice or possession order where vacancy depends on ending a let.
  6. Licence to occupy or caretaker note where anyone remains with consent.
  7. Buildings insurance schedule with unoccupied endorsements stated.
  8. Photographs that match the empty claim, including boarded or alarmed stock.
  9. Sale diary, refinance illustration or works start note that fits the occupancy story.
  10. Any goods-left-behind or clearance plan called out in plain English on page one.

Identity, source of funds and company papers still sit in the general packs. They are not replaced by a vacant claim. They sit beside it.

Rates and fees only move when occupancy and exit are both credible. A soft vacant ask with no declaration still costs entry fee, exit fee and monthly interest from 1.25% on the published schedule. If the house will be empty on completion and the exit fits the term, redeem on time and close the file. If someone is still there, bring the notice trail or price the file as occupied before you ask credit to pretend otherwise.

Frequently asked questions

Is a portal listing that says vacant enough for credit?

No. Credit wants a signed empty-property declaration, a contract warranty or auction special conditions that match the claim, plus a key schedule. Marketing copy is not vacant possession evidence.

Can credit fund while a section 8 notice is still running?

Sometimes a DIP can issue on a clear Form 3A trail and expiry date. Funding usually waits until keys are back or until the facility is priced as still occupied with a lawful possession path. Do not treat an unexpired notice as vacant possession today.

What if auction special conditions leave occupation risk with the buyer?

Put the carve-back on page one and price the file as part occupied or subject to occupation. Vacant pricing needs vacant papers. Special conditions that shift risk to the buyer are not a vacant possession warranty.

Does unoccupied buildings insurance replace the empty-property declaration?

No. Insurance shows how the risk is covered. The declaration shows who occupies. Credit wants both when the file is sold as empty, especially after a long void.

How does this pack sit next to the tenancy and deposit pack?

Use the tenancy and deposit pack when the bridge is underwritten as let with rent and deposit evidence. Use this vacant possession pack when the bridge is underwritten as empty. Mixed titles need both, mapped per property.
